The Illustrator is entitled to use of all illustrations for portfolio or self-promotional purposes. Commission ordered can be declined for any reason.
Reassigning of Rights: The illustrator retains all intellectual rights to any of their commissioned images and has the sole power to transfer or sell rights. Client does not have authority to assign or transfer this License or any part thereof to themselves or others. Age: The client must be 18 years or older to purchase a commission or have their parent's consent before purchasing artwork especially with the involvement of credit cards. Usage:
Characters and Adopts:
Payment: All payments are expected in full before the commission is started. An invoice will be sent once both parties agree to the price quote provided by the illustrator. Invoice must be paid within 72 hours of the date issued or the commission will be automatically canceled. If this cancellation should occur, further action may be discussed at the discretion of the client and illustrator. For totals over $250 USD, a payment plan may be made discussed. A down payment must be made before the commission is started, 30-50% at least. The client has up to 3 weeks (or whatever is discussed) to complete the payment. Commission will not be finished or delivered before the entire payment is received. Currency: All commission quotes are in US dollars. Accepted payment methods are Paypal, Venmo, and Stripe. An invoice/statement will be delivered in either case. |
Revisions: The client is entitled to a reasonable number of revisions that are at the fault of the illustrator, including mistakes involving a character's design. (For example, Illustrator colored a character's eyes brown instead of blue.) Any more revisions requested by the client regarding the correction of the illustrator's decisions may incur extra charges (For example, client does not like the way the hair was shaded and would like it to be redone).
Cancellations and Refunds: Should the client choose to cancel after art is started or decide to significantly change their initial order, client agrees to pay the illustrator based on the amount of completion and sunk costs. Remaining percentage will be refunded.
Cancelled commissions and the rights of usage are forfeited by the client. Illustrator may re-purpose any sketches or concept work (poses, color palettes, lines) for new commissions. Re-purposing or reselling of sketches or concept work is true in cases aside from cancellations as well. Forfeiting of Slot: The following conditions will forfeit a client's slot:
Credit: Any artwork that has had the illustrator's signature removed is a violation of the Terms and Service. Client agrees to include a credit to illustrator when shared or displayed. Claiming credit for producing the artwork is considered theft and is also a violation of the Terms of Service. Theft is not tolerated and will be shared with others as warning. Streaming: Illustrator reserves to right to publicly stream the creation of any commissions. Illustrator might not directly inform the client when their commissions is being streamed. Requests to prevent the stream of a commission will be honored in cases of secret gifts, etc. Delivery: The illustrator shall use all reasonable endeavors to deliver the artwork to the client by: A) a reasonable time (less than 6 months); B) a date agreed between the client and illustrator; and shall notify client of any expected delays at the first opportunity in which the client may (unless the delay is the fault of the client) cancel the commission with a refund, keep the progress with partial refund, or choose to continue and wait for the commission to be finished. Errors and Omissions: Any errors or omission of information in the final and accepted project are the full responsibility of the client. Entire Understanding: Agreeing to these terms constitutes the sole agreement between the illustrator and the client regarding the commission(s) in question. Placing an order signifies the client has read the Terms and agrees. Agreement is effective when the the illustrator has accepted the commission(s). Both parties warrant that they have read and understand the terms set forth in this agreement. Both parties ascertain that they will make a good faith effort to abide by the terms. Breach of any of the listed terms will lead to immediate blacklisting. The limited rights of usage assigned to the client by these Terms are voided and the client will not longer be able to use the image. If the illustrator feels the breach of contract was particularly heinous, public awareness may be made against the client. Legal methods may be used in worst case scenarios. |
